PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 6 March 1992, the applicant was convicted in The District Court for the County of Comanche and the State of Oklahoma on one charge: (1) murder in the second degree. The applicant was sentenced to life in the custody of the Department of Corrections of the State of Oklahoma. On 7 July 1992, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—civilian conviction, with an under other than honorable conditions discharge. He was advised of his rights. The applicant’s correspondence mailed to him in reference to consulting with legal counsel and advising him of his rights was returned after 30 days as required by AR 635-200, Chapter 14, unsigned. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with an under other than honorable conditions discharge. On 14 July 1995, the applicant filed an appeal of his civil conviction in The Court of Criminal Appeals of the State of Oklahoma. On 7 August 1995, the Court of Criminal Appeals of the State of Oklahoma affirmed the charges from the District Court. On 29 March 1996, Memorandum from the Adjutant general stated that the approved discharge action on 1 September 1992, by the discharge approving authority will be executed.

         b. On 10 April 1996, the applicant was discharged with an under other than honorable conditions discharge. At the time of discharge, the applicant had completed 3 years, 2 months, and 6 days of active military service and accrued 1,710 days of lost time.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board noted the applicant’s contention that his discharge was based on one isolated offense. Applicable Army regulations state that there are circumstances in which the conduct or performance of duty reflected by a single incident provides the basis for separation and characterization of service. The Board determined that the applicant's discharge was appropriate because of his civilian conviction for 2nd degree murder. This single incident of misconduct clearly diminished the quality of the applicant’s service below that meriting a fully honorable or general discharge and the separation authority appropriately determined that the specific offense warranted separation. Furthermore, eligibility for veteran's benefits does not fall within the purview of this Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
